Your Home Page Terms of Service

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use our Services.

1.  Our Services

Your Home Page is a real estate technology platform that connects digital content to property information. We allow users to view homes, explore related listings, save favorites, and contact real estate professionals. Sellers, landlords, and property managers may add or display their properties, and licensed real estate professionals (“subscribers”) may purchase access to additional tools including branded pages, content-linking features, lead engagement tools, and analytics.

We may use third-party data sources, including MLS providers, rental portals, social media platforms, and other integrated services. Listing information and availability are dependent on these external sources and may change or be unavailable at times.

We may update, change, or improve our Services over time, and certain features may be available only to subscribers or only when third-party integrations are functioning properly. 

2. Eligibility and Account Registration

You must be 18 years of age to use the Services. By agreeing to these Terms, you represent and warrant that: (a) you are at least 18 years of age; (b) you have no previously been suspended or removed from the Services; and (c) your registration and your use of the Services complies with all applicable laws and regulations. To use certain features of the Services, you may need to create an account. When you register for an account, you will be asked to provide certain information about yourself, including email address, phone number, or other contact information. You acknowledge and agree that the information you provide is accurate and that you will keep it up-to-date and accurate at all times. When you register, you will be asked to provide a password. You are solely responsible for maintaining the confidentiality of your account and password, and you are responsible for all actions taken via your account. You may not share your user account(s) with others. Unless you have entered into a commercial agreement with us permitting you to use the Services for transactions on behalf of another person, you may use the Services only for transactions on your own behalf. 

If you identify yourself as a licensed real estate agent or broker and intend to utilize the platform to connect with buyer and sellers, you are required to sign our Software as A Service Agreement and register your account as a licensed real estate agent or broker in order to receive leads. You acknowledge and agree that all leads or buyers are your responsibility and not ours. You additionally represent and warrant that: (a) you hold a valid and active license in the jurisdiction(s) where you operate and (b) You will comply with all applicable laws, regulations, and brokerage requirements. Your Home Page may, but is not obligated to, verify licensure status or representation agreements and reserves the right to terminate your access to the Platform immediately for any and all misrepresentations made in relation to licensure status or representation. If you disconnect your social account or MLS access is interrupted, certain functionality may be limited.

3. Permitted Use and Restrictions

Permitted Use. You may use the Services only for lawful purposes and in accordance with these Terms. As long as you comply with these Terms, we grant you a non-exclusive, limited, revocable, personal, non-transferable license to use the Services for your personal use. If you are a real estate or mortgage professional acting in your professional capacity, you may additionally use the Services to provide information, to the extent permitted by applicable law, to your clients and to take action on behalf of your clients (“Pro Use”). If you use the Services for Pro Use, you represent and warrant that you have obtained all required authorizations and consents from your client. 

Restrictions. You agree not to:

• Access or use the Services for commercial purposes except as authorized by Your Home Page.

• Copy, modify, distribute, display, or otherwise provide access to, or create derivative works based on the Platform.

• Misrepresent property information or upload fake or AI-generated properties. All properties must be for sale or for rent actively.

• Reverse engineer, decompile, or disassemble any part of the Services.

• Circumvent or attempt to replicate Your Home Page’s AI-powered matching or feed structure.

• Use Your Home Page’s content or data outside of legitimate real estate engagement. 

• Scrape, harvest, or use automated systems to access data from the Platform.

• Upload or transmit viruses, malware, worms, or any other harmful or invalid code.

• Remove or modify any copyright or other intellectual property notices that appear in the Services. 

• Use the Services or the Platform in any way that is unlawful, or harms Your Home Page, its service providers, suppliers, affiliates, or any other user.

• Use the Services or the Platform in any way to discriminate against any individual or class of individuals protected under federal, state, or local laws, or which may have a discriminatory impact against any individual or class of individuals, or which otherwise promotes illegal, racist, or discriminatory activities or outcomes. 

• Distribute or post spam or other unsolicited messages, chain letters, pyramid schemes, or similar communications through the Services.

• Impersonate another person, misrepresent your affiliation with another person or entity, or make any representation to any third party under false pretenses. 

• Post, reproduce, publicly display, or otherwise make accessible any content, which we, in our sole judgement and discretion, consider illegal, offensive or objectionable including without limitation content that harasses, discriminates, demeans, threatens, or disparages any individual or class of individuals. 

• Interfere with, or compromise the system integrity or security of the Services, or otherwise bypass any measures we may use to prevent or restrict access to the Services. 

• Use any of the Your Home Page trademarks as part of your screen name or email address

• Access or use any of the Services to develop competitive products or services.

• Attempt to, or permit or encourage any third party to, do any of the above. 

Your Home Page reserves the right to suspend or terminate your access at any time for violation of these Terms.

4. Fees. 

You may be required to pay fees and execute our Software as a Service Agreement in order to access certain features of the Services. All fees are in U.S. dollars and are non-refundable. If we charge the fees for all or part of any of the Services, including by adding fees or charges, we will provide you with advance notice of those changes. If you do not accept the charges, we may discontinue providing the applicable part of the Services to you. Our authorized third-payment processors will charge the payment method you specified at the time of purchase or as agreed to as part of the selected Services. You authorize us to charge all fees as described in these Terms for the Services you select to that payment method. If you pay any fees with a credit card, we may seek pre-authorization of your credit card account before your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase. 

The Services may include features that allow for automatically recurring payments for periodic charges (“Subscription Service”). If you decide to activate a Subscription Service, you authorize us to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on or before the payment due date for the accrued sums. The subscription will continue unless and until you cancel your subscription, or we terminate it. You must cancel your Subscription Service before it renews in order to avoid billing of the next periodic subscription fee to your account. We will bill the periodic subscription fee to the payment method you provide to us during registration (or to a different payment method if you change your payment information). We may change the subscription fee for any subsequent subscription period but will provide you advance notice of any increase before it applies. You may cancel a Subscription Service through the settings page in your account, or by contacting us at [email protected].

5. User Content and License

You may post, upload, or otherwise provide content such as text, images, photos, video, data, listings, reviews, feedback, or other content (“User Content”).

By submitting User Content, you grant Your Home Page a worldwide, royalty-free, perpetual, irrevocable, transferable license to use, copy, reproduce, distribute, modify, transmit, publicly perform, display, edit, and create derivative works from such content in connection with the Services and our business operations, including but not limited to marketing purposes. Your Home Page may also sublicense these rights, to the maximum extent permitted by applicable law. We will not pay you for your User Content or to exercise any rights related to your User Materials set forth in the preceding sentences. We may remove or modify your User Content at any time. You are solely responsible for all User Content made through your user account(s) on the Services or that you otherwise make available through the Services. 

You represent and warrant that you are the creator and own or have the necessary rights to grant this license, rights consent, and permissions to authorize Your Home Page and other users to access and use your User Content as necessary to exercise the licenses granted by you under these Terms. You represent and warrant that your User Content will not infringe or violate the rights of any third party or applicable law.

We are under no obligation to edit or control User Content and will not be in any way responsible or liable for any User Content. We may, however, at any time and without prior notice, screen, remove, edit, or block any User Content on the Services for any reason including User Content that in our sole discretion violates these Terms or we otherwise find objectionable. You understand that when using the Services, you may be exposed to User Content of other users and acknowledge that User Content may be inaccurate, offensive, indecent, or objectionable. You agree to waive, and do waive, any legal or equitable right or remedy you may have against us with respect to User Content. We expressly disclaim any and all liability in connection with User Content. If notified by user or content owner that User Content allegedly do not conform to these Terms, we may investigate the allegation and determine in our sole discretion whether to remove that User Content, which we reserve the right to do at any time and without notice. For more information on our handling of infringement content, please see Section 8 below. 

6. Proprietary Rights

All rights, title, and interest in and to the Services and the Platform (including but not limited to software, databases, content, AI models, content-matching systems, recommendation engines, listing-similarity logic, related data processing tolls and trademarks) are owned and retained by Your Home Page or its licensors. The user interfaces, designs, information, data, code, products, software, graphics, and all other elements of the Services (the “YHP Materials”) that we provide are protected by intellectual property and other laws and are the property of Your Home Page or its third party licensors. Except as expressly allowed by these Terms, you may not make use of the YHP Materials, and Your Home Page reserves all rights to the YHP Materials and Services not granted expressly in these Terms. You may not attempt to replicate, reverse engineer, or use the output to build competitive systems. 

Certain content on the Services are owned by third parties. The names of actual companies, products, and services mentioned herein may be trademarks of their respective owners. Any rights not expressly granted herein are reserved. We do not assert copyright or grant any rights to the underlying images or descriptions of real estate listing provided through the Services. Any use of these images and descriptions is subject to the copyright owner’s permission and the requirements of applicable law. 

7. Feedback

If you choose to provide input or suggestions regarding the Services, including related to any of the YHP Materials (“Feedback”), then you hereby grant us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve the Services or create other products and services.  

8. DMCA; Claims of Copyright Infringement. 

We respect the intellectual property rights of others and ask that everyone using the Services do the same. Anyone who believes that their work has been reproduced on the Services in a way that constitutes copyright infringement may notify us in accordance with Title 17, United States Code, Section 512(c)(2), by providing the following information by either mail or email as outlined below. 

1. Identification of the copyrighted work that you claim has been infringed; 

2. Identification of the material that you claim is infringing and needs to be removed, including a description of where it is located on the Services so that the copyright agent can locate it;

3. Your address, telephone number, and, if available, email address, so that the copyright agent may contact you about your complaint; and 

4. A signed statement that the above information is accurate; that you have a good faith belief that the identified use of the material is not authorized by the copyright owner, its agent, or the law; and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf in this situation.

9. Privacy

Your Home Page collects and uses personal information in accordance with its Privacy Policy. By using the Services, you consent to our collection and use of your data as described therein.

10. Third-Party Links and Services

The Services may include links to or integrations with third-party websites, products, or services. This includes but is not limited to third-party MLS providers, rental portals, meta Platforms and CRM integrations. Your Home Page is not responsible for the content, accuracy, or practices of third parties and does not endorse any third-party site or offering. Your use of such third-party services is at your own risk and subject to their separate terms. Accuracy of listing data depends on third-party sources which may not always be available or updated. If MLS or meta revokes access, features may pause temporarily.

11.   Disclaimers

THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” AND  THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR HOME PAGE MAKES NO REPRESENTATIONS, WARRANTIES, OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION. YOUR HOME PAGE EXPRESSLY DISCLAIMES ANY WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING OR USAGE OF TRADE AND WARRANTIES OR CONDITIONS OF UNINTERRUPTED OR ERROR-FREE ACCESS OR USE. YOU ASSUME ALL OF THE RISK FOR ANY DAMAGE THAT MAY RESULT FROM YOUR USE OF OR ACCESS TO THE SERVICES, YOUR DEALING WTH ANY OTHER USER, AND ANY MATERIALS, INCLUDING USER CONTENT AND YHP MATERIALS, AVAILABLE THROUGH THE SERVICES. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES, AND USE, ACCESS, DOWNLOAD, OR OTHER OBTAINMENT OF MATERIALS THROUGH THE SERVICES AND ANY ASSOCIATED SITES OR SERVICES, ARE AT YOUR OWN DISCRETION AND RISK, AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER SYSTEM OR MOBILE DEVICE USED IN CONNECTION WITH THE SERVICES), OR THE LOSS OF DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OR USE OF THOSE MATERIALS. SOME JURISDICTIONS MAY PROHIBIT A DISCLAIMER OF WARRANTIES AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.

YOUR HOME PAGE DOES NOT GUARANTEE THE COMPLETENESS, RELIABILITY, ACCURACY OR TIMELINESS OF LISTINGS, PRICING, PROPERTY DATA, OR OTHER INFORMATION MADE AVAILABLE THROUGH THE SERVICES. MLS OUTAGES OR DATA DELAYS MAY OCCUR. 

YOU EXPRESSLY ACKNOWLEDGE THAT RECOMMENDATIONS MADE WITHIN THE PLATFORM ARE AUTOMATED AND ARE NOT GUARANTEED. YOUR HOME PAGE IS NOT A BROKER REPRESENTING BUYERS. THE LICENSED REAL ESTATE AGENT USERS SUBSCRIBED TO OUR PLATFORM HANDLE ALL REPRESENTATION. BUYERS DECIDE WHETHER TO CONTACT SUBSCRIBERS. YOUR HOME PAGE DOES NOT GUARANTEE LEADS. 

12. . Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUR HOME PAGE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL ARISING OUT OF, BASED ON, OR RESULTING FROM THESE TERMS OR YOUR USE OR ACCESS, OR INABILITY TO USE OR ACCESS, THE SERVICES OR ANY MATERIALS ON THE SERVICES, WHETHER BASED ON: (A) BREACH OF CONTRACT; (B) BREACH OF WARRANTY; (C) NEGLIGENCE; OR (D) ANY OTHER CAUSE OF ACTION, EVEN IF YOUR HOME PAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AGGREGATE LIABILITY OF YOUR HOME PAGE AND ANY OF OUR AFFILIATES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS OF USE, WHETHER UNDER CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (1) THE AMOUNT YOU HAVE PAID TO YOUR HOME PAGE FOR THE SERVICES IN THE 12 MONTHS PRIOR TO THE EVENTS OR CIRCUMSTANCES GIVING RISE TO THE CLAIMS; OR (2) $100. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES. ACCORDINGLY, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. EACH PROVISION OF THESE TERMS OF USE THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE AGREEMENT OF THE PARTIES. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS ITS ESSENTIAL PURPOSE.

13.   Indemnification

You agree to defend, indemnify, and hold harmless Your Home Page, its affiliates, officers, employees, and agents from and against any and all claims, demands, damages, obligations, losses, liabilities, and expenses (including attorneys’ fees) due to or arising out of: (i) Your use or misuse of the Services; (ii) Your violation of these Terms or applicable law; (iii) any dispute or issue between you and any third party; (iv) Your User Content or any infringement of third-party rights; (v) your willful misconduct; (vi) any other party’s access to or use of the Services using your account and password, (vii) MLS or licensing violations, misrepresentation of listing data or unauthorized use of buyer information. Your Home Page reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in that case, you agree to cooperate with Your Home Page’s defense of that claim. 

14.   Termination

Your Home Page may terminate or suspend your account or access to the Services at any time, with or without notice, for any reason, including a violation of these Terms or if your account becomes inactive.

Upon termination, your right to use the Services will immediately cease, and certain provisions (including those related to ownership, warranties, indemnity, and limitations of liability) will survive. We will not be liable whatsoever for any suspension or termination of your access to, or use of the Services. 

15.   Deactivation and Deletion of Data

You may deactivate your account at any time by selecting “deactivate account” in your account settings. You can delete your account and all your account data by submitting a request to “delete your data” to [email protected]. If you deactivate or delete your account, you remain obligated to pay all outstanding fees, if any, incurred prior to termination relating to your use of the Services. All linked posts, listings, matches, saved homes, and preferences will be disabled and permanently removed. 

16.   Modifications to the Terms

Your Home Page may update these Terms from time to time. Changes will be posted on the Platform with the updated effective date. Your continued use of the Services after any modification constitutes your acceptance of the new Terms. We will not be liable whatsoever for any changes to these Terms or changes to the Services. You further waive any right you may have to receive specific notice of such changes to these Terms of Use. You are responsible for regularly reviewing these Terms of Use.

17.   Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles.  You agree that any disputes shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of such courts.

18.   Miscellaneous

• Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Your Home Page for consumer use of the Services. For commercial use of the Services, you must also enter into the Your Home Page SAAS Agreement. 

• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, in whole or in part, at any time with or without notice to you. 

• Severability. If any provision is found unenforceable, then the invalid or unenforceable provision will be replaced with a valid, enforceable provision that most closely matches the intent of the original provision and the remainer of these Terms will continue in effect. 

• Waiver. Our failure to enforce any right or provision shall not be deemed a waiver of such right.

• Section Titles. The section titles in these Terms are used solely for the convenience of the parties and have no legal or contractual significance. 

• Notice to California Residents. If you are a California resident, under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, California 95834, or by telephone at (800) 952-5210 in order to resolve a complaint regarding the Service or to receive further information regarding use of the Service.

• Contact Information and License Disclosures. The Services are offered by Finding Floridians, LLC d/b/a Your Home Page and its affiliates, located at 4604 49th St N #5091 St Petersburg, FL 33709.
